Email Ballots or Paper Ballots

Many owners in common interest developments would prefer to vote by email became it is more convenient and less expensive than paper ballots. However, the Davis-Stirling Common Interest Development Act requires every homeowner association to use the double envelop paper system of voting for the following types of elections:

  • Elections of directors,
  • Removal of directors,
  • Special assessments,
  • Amendments and restatements of the CC&Rs,
  • Amendments and restatements of the Bylaws, and
  • Conveyances of common area.

If an election falls outside one of the listed categories, it can be conducted electronically, if the board of directors votes to conduct the election by email.
